Puerto Rico Demurrage Charges Update – Effective July 8, 2012

Dear Valued Customer,

Please note the following revised Puerto Rico Demurrage Charges effective July 8, 2012.

Rule 21E

Upon expiration of the free time period provided in this RULE, the following demurrage charges, per trailer, per day or fraction thereof, including Saturdays, Sundays and Holidays (See RULE 101) will be assessed until trailer is returned to carrier’s terminal. (See NOTES 1, 2 and 3). 
 
Dry Equipment or Chassis
1-5 days             $35.00 per day (currently $25)
6 days or more     $70.00 per day (currently $50) 
 
Refrigerated Equipment
For the first two (2) days      $75.00 per day (currently $55)
For each succeeding day     $150.00 per day (currently $100)
 
Tank Equipment
For the first day                  $75.00 per day (currently $55)
For each succeeding day     $150.00 per day (currently $100)
 
Flatbed Equipment
1-5 days               $75.00 per day (currently $25)
6-10 days            $150.00 per day (currently $50)
11 days or more    $200.00 per day (currently $100)
 
Lowboy Equipment
For the first two (2) days    $150.00 per day (currently $50)
For each succeeding day     $300.00 per day (currently $125)
 
Open Top Equipment
1-5 days              $50.00 per day (currently $25)
6 days or more     $100.00 per day (currently $50)
 
Cargo Not Moving in Trailers
For the first 5 calendar days (Including Saturdays, Sundays and Holidays)  $20.00 per day (no change) per item
For each succeeding day (Including Saturdays, Sundays and Holidays)      $30.00 per day (no change) per item

Vehicles, Self-Propelled
For the first 5 calendar days (Including Saturdays, Sundays and Holidays $5.63 per day (no change) per vehicle
For each succeeding day (Including Saturdays, Sundays and Holidays)    $8.44 per day (no change) per vehicle
 
NOTE 1:  Whenever freight remains undelivered, through no fault of the carrier, after expiration of free time as provided herein, carrier may place the freight in a public storage warehouse at the expense of and for the account of the consignee or owner.
 
NOTE 2:  No demurrage is applicable for delay caused by carrier in receipt of trailer. Claims for waiver of demurrage in such instances shall be filed in writing, stating all facts upon which the claim is based. Such claims shall be allowed where carrier fault is established.
 
NOTE 3:  Claims for refunds of demurrage charges must be presented in writing to the carrier within one year of the date that the cause of action accrues and will be allowed only when proof of error is submitted by customer or his representative.
