Puerto Rico Ports Authority (“PRPA”) Scanning Fee

A judgement by the Puerto Rico Court of Appeals on October 20, 2016 in the case of Cámara de Mercadeo, Industria y Distribución de Alimentos (“MIDA”) v. Autoridad de los Puertos; Case No. KLRA201601056 ordered the Puerto Rico Ports Authority (“PRPA”) to immediately cease and desist charging container security scanning fees to its port users.
The PRPA has confirmed that no container security scanning fee will be charged on vessels arriving on or after October 20, 2016. The PRPA will however continue to scan all containers, albeit with no fee. Accordingly, Crowley will no longer charge the container security scanning fee on vessels arriving on or after October 20, 2016. We expect that the legal controversy surrounding the challenge to the scanning fee will remain fluid. We will update you with any additional information as it becomes available.
