REVISED: UPDATE & New Effective Date – Puerto Rico Ports Authority Scanning Fee

In an attempt to minimize the impact of the associated cost to the trade, Crowley has analyzed all available data related to the new Puerto Rico Ports Authority Enhanced Security Fee (Cargo Scanning Fee) and will be reducing the filed amount to $74 per container / tank / flatbed or flat rack equipment.

Please note the following update regarding the implementation of the Puerto Rico Ports Authority (PRPA) Enhanced Security Fee (Cargo Scanning Fee):

1. The implementation date has been postponed by the PRPA to October 24, 2011.  PRPA will apply this fee to all vessels arriving in San Juan as of this date.

2. There has been a complaint filed in the District Court of Puerto Rico by local interests who are seeking a temporary restraining order (TRO) against the PRPA’s plan to implement the Enhanced Security Fee.  A judge has not yet ruled on the whether or not a TRO will be granted.

As previously communicated, the new regulation “aims to regulate and govern the procedures at the new inspection facilities to be established by the Puerto Rico Ports Authority in its maritime ports facilities at the port of San Juan.  The measure seeks to accommodate the interest of the Department of Treasury to inspect up to 100% of all Inbound Cargo Containers, in order to identify unreported taxable goods, by a non-intrusive scanning (imaging) system that preserves a free and efficient flow of commercial traffic at the ports.”

The ocean carriers have been tasked with collecting the scanning fee on behalf of the government.  As a direct result, please note the following Puerto Rico Ports Authority Scanning Fee that will be effective October 16, 2011 and applies to all service contract and open tariff shipments with a final destination of San Juan:

Scope:  U.S. to San Juan (inbound to San Juan)

$74 per container / tank / flatbed / flat rack (all sizes)
 $10 per vehicle up to and including 800 cubic feet
 $15 per vehicle exceeding 800 cubic feet
 $5   per short ton NIT

Caribbean / Central America to San Juan

Effective Date:  11/3/11

Scope:  Caribbean, Virgin Islands, British Virgin Islands, Bahamas, Dominican Republic, Haiti, and Central America to San Juan (inbound to San Juan)

$74 per container / tank / flatbed / flat rack (all sizes)
 $10 per vehicle up to and including 800 cubic feet
 $15 per vehicle exceeding 800 cubic feet
 $5   per short ton NIT
