Notice of Force Majeure – Sept 1, 2005 3:30pm EST

TO ALL CUSTOMERS:

As a result of damage caused by Hurricane Katrina and its aftermath, Crowley Liner Services, Inc. is unable to safely operate in the affected region and no cargo is being moved in, out or through that area for the foreseeable future. In accordance with Clause 18 of Crowleys Bill of Lading, General Exceptions, and/or any similar provisions contained in an applicable ocean shipping service contract, Crowley is unable to meet any obligations because of this Act of God, or Force Majeure event. Accordingly, performance under any such bills of lading or contracts is, to that extent, frustrated and no cause of action for breach or liability will arise as a consequence of this Force Majeure. We are unable to determine how long this Force Majeure will continue and regret any inconvenience this tragic event has caused you due to these circumstances beyond our control.

Crowley personnel are working with customers on a case-by-case basis to move cargo on the safest alternate routes available at this time and we will continue to keep our customers advised when further information is available.

Apparel shippers may make bookings through the companys apparel desk in Miami at 1-800-835-2807.
